105.10 WASTE STORAGE CONTAINERS.
Every person owning, managing, operating, leasing or renting any premises, dwelling unit or any place where refuse accumulates shall provide and at all times maintain in good order and repair portable containers for refuse in accordance with the following:
1.   Container Specifications. Waste storage containers shall comply with the following specifications:
   A.   Residential. Residential waste containers shall be provided by and shall remain the property of the City. Each account holder has the choice to be assigned a 35-gallon or 65-gallon waste container. Each waste container will have a serial number imprinted on the waste container. The waste containers shall be assigned to each property address, and as such, the waste containers shall be left at the property upon a change of occupants. In the event that the account holder desires to change sizes of waste container after the account holder’s initial choice, the account holder will be charged an administrative fee as set by resolution of the Council. Lost, stolen, damaged, or destroyed waste containers shall be replaced at the expense of the owner/occupant at a cost to be set by resolution of the Council.
   B.   Commercial. Every person owning, managing, operating, leasing or renting any commercial premises where an excessive amount of refuse accumulates and where its storage in portable containers as required above is impractical, shall maintain metal bulk storage containers approved by the City.
2.   Storage of Containers. Residential solid waste containers shall be stored upon the residential premises. Commercial solid waste containers shall be stored upon private property, unless the owner has been granted written permission from the City to use public property for such purposes. The storage site shall be well drained; fully accessible to collection equipment, public health personnel and fire inspection personnel. All owners of residential and commercial premises shall be responsible for proper storage of all garbage and yard waste to prevent materials from being blown or scattered around neighboring yards and streets.
3.   Location of Containers for Collection. Waste containers shall be placed at the curb or near the edge of the street no later than 7:00 a.m. on collection days, but not prior to 6:00 p.m. on the day before collection days, under the following procedure:
   A.   Waste Containers.
      (1)   The waste container shall have the lid closed.
      (2)   The waste container shall be placed in a manner as to have four feet of clear zone along the sides of the container.
      (3)   The waste container shall be set in a manner whereby the arrows affixed to the waste container are pointed toward the street.
   B.   Bags. Any bag, which shall have a tag issued by the City permanently attached thereto for singular (once only) use, shall be set on top of the waste container for collection. Said tags shall be sold by the City or designated vendor, and be clearly identified as such with the cost thereof being set by resolution of the Council.
All containers shall be removed from the curb edge or the street edge to a point behind the front building line, whether collected or not, by the end of the collection day; and if any containers are allowed to remain at the curb edge or the street edge past collection days, the owner thereof shall be deemed in violation of this section.
4.   Nonconforming Containers. Solid waste containers which are not adequate will be collected together with their contents and disposed of after due notice to the owner. Garbage, refuse, recyclables or yard waste piled on the ground or not in proper containers or receptacles will not be taken by the collector; singular items of refuse which by their nature need not be placed in a receptacle, when left in an orderly manner, will be taken by the collector. In the event garbage, refuse, recyclables or yard waste is not taken by the collector because the same is not acceptable, notice shall be given to the resident.
5.   Ashes. Ashes shall not be placed in any solid waste container unless they have been allowed to cool a minimum of twenty-four (24) hours or have been thoroughly and completely watered down and drained off with no possibility of fire remaining.
