§ 92.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   (1)   Discharge of permissible consumer fireworks in violation of § 92.02 or the failure to comply with the requirements of § 92.04(A) or (B) is a civil offense punishable by a civil fine as follows:
         (a)   First offense: not less than $50 but not more than $250;
         (b)   Second offense within one calendar year: not less than $250 but not more than $500; and
         (c)   Third and subsequent offenses within one calendar year: not less than $500 but not more than $1,000.
      (2)   A person who violates the provisions of §§ 92.01 to 92.06 shall be guilty of a Class 3 misdemeanor punishable by the maximum punishment allowed by law.
