§ 95.10  RIGHT TO JUDICIAL PROBABLE CAUSE HEARING BEFORE SALE AND DISPOSITION OF VEHICLE.
   After the removal of a motor vehicle, the owner or other person entitled to possession has the right to a hearing for the purpose of determining if probable cause existed for removing the vehicle. A request for hearing shall be filed in writing with the county magistrate designated by the chief district court judge to receive the requests. The magistrate shall set the hearing within 72 hours of his or her receipt of the request, and the hearing shall be conducted in accordance with the provisions of G.S. § 20-219.11. Any aggrieved party may appeal the magistrate’s decision to district court.
