5-4-1: DEFINITIONS:
For the purpose of this chapter, the following terms shall have the meanings ascribed to them in this section:
FIREWORKS: Any combustible or explosive composition or any substance, combination of substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation and includes skyrockets, roman candles, bottle rockets, dayglo bombs, blank cartridges, toy cannons, toy canes or toy guns in which explosives other than toy paper caps are used, the type of balloons which require fire underneath to propel them, firecrackers, torpedoes, sparklers or other fireworks of like construction, any fireworks containing any explosive or flammable compound, or any tablets or other device containing any explosive substance.
PERMISSIBLE FIREWORKS: As set forth in the hazardous material regulations (HMR; 49 CFR parts 171 - 180, specifically regulations applicable to fireworks in section 173.56(j) and the hazardous material table section 172.101). Montana Code Annotated title 50, chapter 37 specifically prohibits skyrockets, roman candles and bottle rockets.
PROHIBITED FIREWORKS: Skyrockets, roman candles and bottle rockets. Illegal explosives are usually unlabeled and these devices exceed the federal maximum explosive charge allowed. Some examples are M-80s, M-100s and silver salutes. (Ord. 408, 7-8-2014)
