§ 38.21 EMPLOYER NOTIFICATION.
   It will be a condition of employment that the employee will abide by the terms of this provision; and, notify the employer in writing of any criminal drug statute conviction for a violation occurring in the workplace no later than five calendar days after such conviction, and the city thereafter, at its discretion, will take one of the following actions within 30 calendar days of receiving notice with respect to any employee who is so convicted:
   (A)   Take appropriate personnel action against the employee, up to and including termination; or
   (B)   Require such employee to satisfactorily participate in a drug abuse assistance or rehabilitation program approved for such purposes by a federal, state or local health, law enforcement or other appropriate agency (Public Law 100-690 Title V, Subtitle D, 41 U.S.C. 701 et seq.).
