§ 152.99 PENALTY.
   (A)   Remedies and enforcement. Remedies and enforcement of the provisions of this chapter are set forth in IC 36-7-4-1000, “1000 SERIES - REMEDIES AND ENFORCEMENT.”
   (B)   Violations as common nuisance. Any structure erected, raised, or converted, or land or premises used, in violation of this chapter, is a common nuisance and the owner or possessor of the structure, land, or premises is liable for maintaining a common nuisance.
   (C)   Penalty. Any person or corporation in violation of this chapter may be punished subject to the provisions of IC 36-1-3-8, specifically:
      (1)   A fine of not more than $2,500 for a first violation of the ordinance; and
      (2)   A fine of not more than $7,500 for a second or subsequent violation of the ordinance.
