§ 112.07 PROHIBITED BUILDING SITES.
   No permit shall be granted for any filling station to be erected:
   (A)   On real estate within that area of the city, which has been zoned by the Plan Commission of the city and designated a residential district.
   (B)   On any real estate in that area of the city, which has been zoned by the Plan Commission of the city and designated a general business district, if any part of the real estate on which the proposed filling station will be located is less than 100 feet from any part of the real estate owned or used by any school or church.
   (C)   On any real estate in that area of the city which has been zoned by the Plan Commission of the city and designated a local business district, if any part of the real estate on which the proposed filling station will be erected is less than 300 feet from any part of the real estate owned or used by any school or church.
   (D)   However, when a school or church closer than the limits provided in divisions (B) and (C) hereof, shall, in writing, waive the distance requirements prescribed in those divisions, then a permit may be granted.
