§ 91.04  SALE OF CEMETERY PLOTS.
   (A)   After the effective date of this chapter, cemetery plots shall be sold by the township for the purpose of burial for the purchaser of a cemetery plot. No sale shall be made to funeral directors or others, except for those acting as an agent for an eligible purchaser.
   (B)   All sales and transfers of cemetery plots shall be made on a form approved by the Township Board and signed by the designated township official, which grants a right of burial only and does not convey any other title or right to the cemetery plot or burial space sold. Such forms shall be signed by the Township Clerk or Deputy Township Clerk, and shall constitute a permit when approved.
   (C)   All lots/graves must be paid in full before delivery of a certificate of title for burial rights or before burial can be allowed. Lots/graves are to be sold in areas designated by the sexton only. No lots are to be sold on Saturday or Sunday unless there is an emergency. Checks shall be payable to the township.
   (D)   The heirs of any lot/grave shall secure a transfer permit from the Township Clerk and submit appropriate documentation showing their right to ownership.
   (E)   Any lot/grave owner authorizing the burial of a person in a grave owned by him or her shall obtain a transfer permit to the Township Clerk prior to interment.
   (F)   Any lot/grave owner desiring to sell his or her lot/grave or a portion thereof shall first offer it to the Township Board at the same price for which it was originally purchased, and if declined by the Township Board, may then sell it to another buyer. To complete such sale, the owner shall obtain a transfer permit from the Township Clerk.
   (G)   The charge for the transfer of ownership shall be as set forth by the township from time to time, payable to the township.
   (H)   All transfers must go through the Township Clerk. Any transfers not going through the Township Clerk will not be recognized.
