§ 53.01 GENERAL PROVISIONS AND PROHIBITIONS.
   (A)   No person, partnership, corporation or other legal entity shall hereafter tap into or connect to any portion of the town sewer system without first receiving a permit from the town.
   (B)   The provisions of division (A) above are applicable to connecting to any sewer service lines, or sewer private lines to residences, or any connecting to any line anywhere which shall ultimately deliver sewer or wastewater to the town wastewater treatment plant, shall require a permit.
   (C)   (1)   Any sewer line of four inches in diameter or less shall be deemed to serve only one single-family residence or business, and those sewer lines shall require a permit before connecting to the town sewer system.
      (2)   No additional connections may be made thereafter to these lines and the residence or business owner shall retain all maintenance of, including cost of maintenance, of these lines.
   (D)   (1)   Any sewer line of greater than four inches in diameter shall be deemed to ultimately have the capacity to serve more than one single-family residence or business, and these sewer lines shall also require a permit before connecting to the town sewer system.
      (2)   Before a permit shall be issued for these lines, however, the property owner requesting the connection must convey title and an easement allowing maintenance to these size sewer lines to the town and must as a condition precedent to connecting meet town specifications for sewer lines. These sewer lines shall thereafter be a part of the town sewer system and shall be maintained by the town.
   (E)   In the event the property owner fails to convey title and easement to the town of any sewer connection of more than four inches in diameter pursuant to division (C) above, the act of connection to the town sewer system of any line larger than four inches in diameter, shall be deemed to have conveyed ownership and title to the sewer line, as well as an easement for maintenance of the line, to the town, unless the Board specifically elects to treat the sewer line differently, or order its disconnection.
   (F)   This chapter shall take effect and be in force from and after its date of passage.
