The municipal water utility may accept the offer of any prospective customer or developer to construct at his sole cost and expense and to donate to the municipal water utility any transmission or distribution main extensions upon the following conditions and in the following numerical order:
1. Detailed plans and specifications for such construction project shall be submitted to the municipal water utility and to all other regulatory agencies for approval. Proof of approval of all regulatory agencies shall be given to and approval obtained from the municipal water utility prior to the commencement of any construction.
2. The municipal water utility shall be notified, in writing, prior to commencement of construction and shall be afforded the opportunity, at all times, to inspect the project during construction.
3. Upon completion of construction of such project, a certificate shall be filed with the municipal water utility by an engineer who is registered with the state certifying that such project had been constructed in accordance with the plans and specifications theretofore filed with the municipal water utility.
4. A written tender of donation of such transmission or distribution main extensions shall be presented to the municipal water utility, together with a performance bond of the contractor in such amount and with such sureties acceptable to the municipal water utility indemnifying and protecting the municipal water utility against imperfections in material, equipment and workmanship which may become apparent during the period of one year subsequent to the date of presentation of such tender and acceptance by the municipal water utility; provided, that the donor shall, at his expense, remove and replace, in whole or in part, any such work, material and equipment which may prove defective or unsuitable for the service performed or to be performed or which may show unreasonable deterioration within such period upon the written demand and to the full satisfaction of the municipal water utility.
