It shall be the duty of every person owning real estate within the city which real estate abuts upon any street the sidewalks of which are paved with concrete, stone, brick or any other paving material, to, at all times, keep the sod or soil next to and on each side of such sidewalk to a level not less than one inch nor more than three inches lower than the surface of such sidewalk, or to dig and keep open a ditch or drain on each side thereof to be a sufficient width and depth to carry off all surface water that may fall or be collected thereon.
