5.16.050 Duties of the city clerk-treasurer, city attorney and telecommunication commission.
   A.   The city clerk-treasurer shall ensure notices are given to the public and each franchisee as required herein and by FCC regulations.
   B.   The city attorney shall rule on any request for confidentiality.
   C.   The telecommunication commission shall be responsible for administering the other provisions herein. Without limitation and by way of illustration:
   1.   The telecommunication commission may submit requests for information to the franchisee and establish deadlines for response to them, as provided in Section 5.16.040.
   2.   For good cause, the telecommunication commission may waive any provision herein or extend any deadline for filing or response except as to such matters as are mandatory under FCC regulations.
   3.   The telecommunication commission shall prepare the recommendations to the city council contemplated by Section 5.16.020 (B) and (C). If the telecommunication commission recommends that any proposed rate increase be denied in whole or in part, it shall:
   a.   Recommend a rate and explain the basis for that recommendation (the telecommunication commission may also recommend that rates remain at existing levels); and
   b.   Recommend whether and on what basis refunds should issue; and
   c.   Notify the franchisee of its recommendations at the time they are submitted to the city council. (Ord. 93-44 § 5, 1993)
