13.16.260 Confidentiality.
   A.   Information and data furnished to the city with respect to the nature and frequency of discharge will be made available to the EPA and IDEM, or any other governmental agency without restriction. Information and data furnished to the city with respect to nature and frequency of discharge will be made available to the public, unless the discharger specifically requests and is able to demonstrate to the satisfaction of the city that the release of such information would divulge information, methods of production entitled to protection as trade secrets or proprietary information of the discharger.
   B.   When requested by a discharger furnishing a report, the portions of a report which may disclose trade secrets or secret processes will not be made available for inspection by the public, but will only be made available upon written request to governmental agencies for uses related to the ordinance, the National Pollutant Discharge Elimination System (NPDES) permit, state disposal system permit and/or the pretreatment programs; provided, however, that such portions of a report will be available for use by any state agency in judicial review or enforcement proceedings involving the discharger furnishing the report. Wastewater constituents and characteristics will not be recognized as confidential information.
