13.16.250 Notice of violation--Repeat sampling and reporting.
   A.   If sampling performed by an industrial user indicates a violation, the industrial user must notify the control authority within twenty-four hours of becoming aware of the violation. The industrial user shall also repeat the sampling and analysis and submit the results of the repeat analysis to the control authority within thirty days after becoming aware of the violation. The industrial user is not required to resample if the POTW performs monitoring at the industrial user's at least once a month, or if the POTW performs sampling between the industrial user's initial sampling and when the industrial user receives the results of this sampling. Where the control authority has performed the sampling and analysis in lieu of the industrial user, the control authority must perform the repeat sampling and analysis, unless it informs the user of the violation and requires the user to perform the repeat analysis.
   B.   The strength of wastewaters shall be determined, for periodic establishment of charges provided for in the rate ordinance, from samples taken at the aforementioned structure at any period of time and of such duration and in such manner as the city may elect, or, at any place mutually agreed upon between the user and the city. Appropriate charges for sampling and analysis may be assessed to the user at the option of the city. The results of routine sampling and analysis by the user may also be used, for determination of charges after verification by the city.
