(a) Title, Purpose, Applicability.
(1) Title. This section shall be known as the Village of Columbus Grove Auxiliary Police Force Ordinance.
(2) Applicability. This section shall apply to the incorporated territory of the Village of Columbus Grove and Village owned property outside the incorporated territory.
(3) Purpose. This section is adopted for the further preservation of the public peace, safety and good order of the Village of Columbus Grove, Ohio.
(b) Definitions. As used in this section, the following terms shall have the following meanings, unless the context clearly indicates that a different meaning is intended:
(1) "Auxiliary Police Force" means a supplemental police contingent comprised of state certified personnel selectively used to conduct of variety of operational support and administrative assignments.
(2) "Auxiliary Police Officer" means a person appointed to the Auxiliary Police Force.
(3) "Police Department" means the Police Department of the Village of Columbus Grove, Ohio.
(c) Appointment, Authority and Functions.
(1) Appointment. The Mayor shall have the authority to appoint as Auxiliary Police Officers as many persons of good character as he shall deem necessary, and their appointment shall be revocable at any time by the Mayor.
(2) Uniforms, equipment, organization. regulations and training. The Chief of Police shall have the authority to prescribe the uniform, equipment, organization, regulations and training as is deemed necessary for the operation of the Auxiliary Police Force. Said Auxiliary Police Force shall be under the command of the Chief of Police and obey the chain of command of the Village Police Department.
(3) When auxiliary police personnel may be called into service. The Chief of Police or Mayor may call into service such Auxiliary Police Officers:
A. In time of public emergency;
B. At such times as there are insufficient number of regular police officers to preserve the peace, safety and good order of the community;
C. At any time for the purpose of training such Auxiliary Police Officers.
(4) Powers: immunities. The members of the Auxiliary Police Force, when called into service by the Chief of Police or Mayor, and at his authority shall have all the powers and immunities of member of the Police Department, subject to such limitations on powers as may from time to time be prescribed in General Orders for such Auxiliary Police Force.
(5) Jurisdictional limitations. The members of the Auxiliary Police Force shall not be required to act beyond the limits of the jurisdiction of the Village of Columbus Grove except when called upon to protect any public property belonging to the Village which may be located beyond its boundaries, or as required by mutual aid contract between the Village and other partial subscribers.
(6) Compensation. Auxiliary Police Officers shall serve as such with compensation as set forth per the Personnel Policy and Procedure Manual.
(7) Insurance. The following insurance coverage shall be provided by the Village for members of the Auxiliary Police Force; injury, liability, property damages and Workers' Compensation.
(8) Auxiliary personnel to wear uniforms and equipment. Auxiliary Police Officers shall wear the uniform and equipment prescribed by the Chief of Police at all times while serving as Auxiliary Police Officers, which shall be purchased and paid for by the Village and shall remain the property of the Village. This provision shall not be interpreted as preventing an Auxiliary Police Officer from being assigned to duty in plain clothes.
(9) Eligibility requirements; application for membership. Any citizen of the United States, who is a resident of the State of Ohio, and who is over the age of 21, shall be eligible to become an Auxiliary Police Officer. Applicants shall apply and will be selected in the form and manner prescribed by the Mayor.
(10) Conflicts of interest. Applicants for the Auxiliary Police Force must not be employed in positions presenting a potential conflict of interest.
(11) Purpose. This section is for the protection of public peace, health, property, safety and general welfare, and neither the Village nor any agent or representative of the Village, an officer appointed under this section, or any individual, firm, partnership, corporation, or receiver or trustees or any other agent thereof, who in good faith executes any executive order or rule promulgated pursuant to this section shall be liable for injury or damage sustained as the direct or proximate result of such action.
