1165.01 STANDARDS FOR CONDITIONALLY PERMITTED USES.
   Before the Board of Zoning Appeals authorizes the release of a Conditional Use Permit for any of the following, a site development plan (or remodeling plan, in the case of a dwelling conversion) shall be reviewed by the Board. The applicant shall demonstrate intent to comply with the provisions of this chapter.
   (a)   Automotive service stations/repair garages are conditionally permitted in both of the Commercial Districts, provided they observe the following:
      (1)   There shall be a minimum of two (2) separate driveways providing entrance and exit to and from the property, located not closer than twenty (20) feet from one another, ten (10) feet from an adjacent property line, and twenty- five (25) feet from any adjacent R-Zoning District.
      (2)   All hydraulic lifts, oil pits and all lubricants, greasing, automobile washing and repair equipment shall be enclosed entirely within the service station or garage building.
      (3)   The entire lot area, exclusive of the area covered by the building, shall be paved or landscaped. A four (4) inch high curb shall separate all paved areas from all landscape areas.
      (4)   The light from exterior lighting shall be so shaded, shielded or directed that the light intensity or brightness shall not be objectionable to surrounding development.
      (5)   A solid fence, wall or evergreen hedge four to six feet high shall be constructed or planted, and maintained in good condition, where the site is located adjacent an R-Zoning District.
      (6)   Within the C-1 District, all major repair work, as defined herein, shall take place within an enclosed building.
      (7)   Within the C-1 District, no long-term, outdoor storage of dismantled vehicles shall be permitted.
   (b)   Drive-In/Carry-Out Food Establishments in the C-1 District. Drive-in restaurants and/or carry-out food establishments are conditionally permitted in the C-1 Zoning District, provided the following conditions are met:
      (1)   The location must bear an acceptable relationship to a major street; said street must be adequate to carry the additional traffic generated by the establishment.
      (2)   The light from the exterior lighting, including illuminated signs, shall be so shaded, shielded or directed that the light intensity or brightness shall not be objectionable to any adjacent dwelling units.
      (3)   A solid fence, wall, or evergreen hedge, four (4) to six (6) feet in height shall be constructed where an off-street parking area is located adjacent to a dwelling unit or "R" zoning district.
      
   (c)   Conversion of Dwellings to Accommodate a Greater Number of Dwellings Units.
The intent of this section is to enable the owners of larger pre-existing single-family dwellings in the R-2 District to convert the properties to two-family dwellings. Also, dwellings in the C-1 and R-3 Districts may be converted to accommodate a greater number of units. A remodeling plan shall be presented to the Board of Appeals which demonstrates intent to comply with the following:
      (1)   Off-street parking. Two additional spaces per added unit shall be provided.
      (2)   Each proposed unit shall be served by Village water and sewer facilities.
      (3)   No new dwelling unit shall be created which has a floor area of less than 500 square feet.
      (4)   No conversion shall result in a lot area per dwelling unit under the following minimum size:
         A.   R-2 District: No lot area less than 3,600 square feet per unit shall be permitted in the case of a proposed two-family dwelling.
         B.   R-3 District: No lot area less than 3,000 square feet shall be permitted in the case of a proposed two-family or multiple-family dwelling.
         C.   C-1 District: No minimum lot area per dwelling unit shall be required in the C-1 District, however, the other requirements of (c)(1), (2), and (3) shall remain in effect.
   (d)   Private Non-Commercial Recreation Areas and Places. Private, non-commercial recreation areas and facilities such as swimming pools, recreation clubs, summer camps, golf courses and country clubs are conditionally permitted in the R-1 and R-2 Residential Districts provided that they meet the conditions outlined below:
      (1)   The site shall contain not less than three (3) acres.
      (2)   The minimum yard requirements shall be as follows:
         A.   Front Yard - 50 feet except 100 feet when fronting on a state highway.
         B.   Side Yard - 40 feet.
         C.   Rear Yard - 50 feet.
(3)   The site shall have adequate access onto a hard surfaced state highway or Village thoroughfare that is regularly maintained and adequate to handle the additional traffic generated by the use.
      (4)   Parking areas shall be a minimum distance of fifty (50) feet from residential uses.
      (5)   Outdoor artificial lighting shall be approved by the Board of Zoning Appeals.
      (6)   If the site contains a swimming pool, the pool area shall be fenced and locked in such a manner as to prevent unauthorized users from entering the pool area during times that the site is not in use.
