(a) Stages. The following water conservation stages shall be in effect at the following times. Total water consumption per day shall be determined by totaling all the treated water pumped by the entire Village water works system. When either Stage 1 or Stage 2 rationing is in effect, no person, firm or corporation shall use any water in violation of any provision of this section.
(1) Stage 1 water rationing. Stage 1 water rationing will be in effect whenever the total water consumption on the preceding day was 150,000 gallons or more. The following requirements will be in effect:
A. After an affirmative vote of a majority of elected Council members at any regular or special meeting on the issue of water rationing, the Waterworks Superintendent shall make public announcements that Stage 1 water rationing is in effect. The announcement shall include a description of the restrictions.
B. No person shall use any water, excluding gray water (recycled), to sprinkle any lawn, any garden, flowers, tree or shrub. These restrictions shall apply to all residences and to all businesses and institutions having lawns, gardens, flowers, trees or shrubs and shall be followed at all parks and public buildings owned by the Village. These restrictions shall not apply to any person, firm or corporation engaged in the business of growing or selling plants of any kind.
C. No water shall be used to wash automobiles, except at places of business where autos are washed on every business day either with attendants, with automatic equipment or by self service.
D. No swimming pools will be filled and no water shall be added to any swimming pool.
(2) Stage 2 water rationing. Stage 2 water rationing shall be in effect whenever restrictions beyond Stage 1 water rationing are necessary so that no water customer inside the Village limits will be without water. After an affirmative vote of a majority of elected Council members at any regular or special meeting on the issue of water rationing, the Waterworks Superintendent shall impose Stage 2 water rationing. The following restrictions shall be in effect:
A. Public information. The Waterworks Superintendent shall provide public information while this section is in effect, including but not limited to the following:
1. Press releases to all the news media.
2. Public service announcements offered to radio, television and cable television stations.
3. Pamphlets or flyers included with water bills.
B. No water, except gray water, shall be used for sprinkling lawns and no water shall be used to water any garden, flowers, shrubs, or trees. These restrictions will not apply to any person, firm or corporation engaged in the business of growing or selling plants of any kind.
C. No water shall be used to wash any motor vehicle, by public or private entity, business, person or corporation.
D. No swimming pools will be filled and no water shall be added to any swimming pool.
E. It is the policy of the Village to keep Stage 2 in effect for no longer than absolutely necessary. The Water Superintendent and Village Council shall take steps to lift the Stage 2 restrictions as soon as lifting the restrictions will not result in any water user being unable to get water.
(b) Reports and Review of Rationing. The Waterworks Superintendent shall make reports to Council at its regular meeting while water rationing is in effect. Council shall review the reports and consider any changes that may be desirable in the regulations set out in this section.
(c) Explanations. The Waterworks Superintendent shall, from time to time, send, along with monthly water bills, an explanation of the regulations set out in this section.
(d) Separability. The provisions of this section are separable and the invalidity of any part of this section shall not affect the validity of the rest of the section.
(e) Penalty. Any person, firm or corporation violating any provision of this section, shall upon first offense receive written warning from the Police Department; shall be fined not less than fifty dollars ($50.00) or no more than one thousand dollars ($1,000) on the second offense; and have water service terminated and incur a fifty dollar ($50.00) re-connection fee to have water service reinstated on the third and subsequent offenses. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
