509.09 MINORS’ CURFEW.
   (a)   Definition. As used in this section, “adult person” means a person eighteen years of age or older.
   (b)   Curfew for Minors Under Twelve. No minor under the age of twelve years shall be upon the public streets, sidewalks, alleys, parks, playgrounds, places of amusement and entertainment or other unsupervised places between the hours of 7:00 p.m. and 6:00 a.m. of the following day from September 1 to May 1 and between the hours of 9:00 p.m. and 6:00 a.m. of the following day from May 1 to September 1. The provisions of this section do not apply to a minor accompanied by his/her parent, guardian or other adult person having the care and custody of the minor or to a minor who is upon an emergency errand, legitimate business or an activity directed by his/her parent, guardian or other adult person having the care and custody of such minor.
   (c)   Minors Under Twelve as Peddlers. No parent, guardian or other adult person having the custody or control of any minor under the age of twelve years shall permit or allow such minor to sell, barter or exchange newspapers, chewing gum or other wares and merchandise or services during the hours of curfew as set forth in subsection (b) hereof on any of the places therein enumerated.
   (d)   Curfew for Minors Between Twelve and Eighteen. No minor between twelve and eighteen years of age shall be upon the public streets, sidewalks, alleys, parks, playgrounds, places of amusement and entertainment or other unsupervised places between the hours of 11:00 p.m. and 6:00 a.m. of the following day, except on Fridays, Saturdays and Sundays when the hours shall be between 12:00 midnight and 6:00 a.m. of the following day. The provisions of this section do not apply to a minor accompanied by his/her parent, guardian or other adult person having the care and custody of the minor or to a minor who is upon an emergency errand or legitimate business or an activity directed by his/her parent, guardian or other adult person having the care and custody of such minor.
   (e)   Responsibility of Parents and Guardians. No person, being the parent, guardian or other adult person having the care and custody of a minor under the age of eighteen years, shall allow or permit such minor to violate any of the provisions of subsections (b) through (d) hereof.
   (f)   Aiding or Abetting Truancy from Home of Minors Under Eighteen. No person shall aid, abet, influence or encourage a minor under the age of eighteen years to be a truant from home when such minor has been reported as being such to the police or juvenile authorities.
   (g)   Aiding or Abetting Violation of Curfew and Peddling Regulations. No person shall aid, abet, influence or encourage a minor under the age of eighteen years to violate any of the provisions of subsections (b) through (d) hereof.
   (h)   Penalty. Whoever violates any of the provisions of this section is guilty of a misdemeanor of the third degree. Punishment shall be as provided in Section 501.99. Minors violating any of the provisions of this section shall be dealt with in accordance with juvenile court law and procedure.
