(A) All rights granted pursuant to this franchise are subject to the police power of the city to adopt and enforce ordinances. Any conflict between the provisions of this franchise and any other present or future lawful exercise of the police powers of the city shall be resolved in favor of the city.
(B) This franchise shall not affect the obligation of all users of the system to comply with all licensure and permit requirements of the city.
(C) Nothing in this chapter shall be in preference or hindrance to the right of the city to perform or carry on any public works or public improvements of any kind. In the event the system interferes in any manner with the construction, maintenance or repair of any public works or improvement, the grantee shall, at its own cost and expense, protect or relocate its system or any part thereof, as directed by the city. The grantee shall repair or replace any city property damaged by it.
(D) The city shall have the right to install and maintain, free of charge, upon the poles and within underground pipes of grantee any wires and fixtures desired by the city.
