§ 3.206 COMMUNITY DEVELOPMENT DEPARTMENT.
   (A)   The Community Development Department is hereby created. The Department shall consist of the office of City Building Official, City Planner, and such other internal administrative positions as are necessary and appropriate.
   (B)   The Community Development Director shall administer the Department and supervise all officers and employees thereof.
   (C)   The Community Development Director shall have supervisory control and responsibility for all building inspections within the city; the enforcement of all applicable codes and regulations relating thereto; and the issuance or denial of all permits relating to building within the city and the collection of all fees relating thereto; the issuance or denial of all licenses and permits that are authorized and approved in a manner prescribed by ordinance; and the establishment of records of all licenses and permits issued and payments thereon.
   (D)   The Community Development Director shall have supervisory control and responsibility for all matters of city involvement affecting physical growth and development within the city including planning, development, redevelopment, and hazardous building act enforcement.
   (E)   The City Planner shall have advisory responsibility on all matters affecting physical growth and development in the city. The City Planner shall also submit recommendations regarding proposed zoning enactments and such other proposals as are referred to him for advice. In making his recommendations, the City Planner shall coordinate all individual projects and programs to ensure harmonious and integrated planning for the city.
   (F)   The Building Official shall enforce and ensure compliance with all applicable laws of the State of Minnesota, and ordinances of the city prescribing standards for construction and maintenance of buildings, the zoning code, and ordinances concerning the maintenance of property in a manner that is detrimental to the health, safety, and welfare of citizens of the city.
      (1)   The Building Official shall act as ex-officio Plumbing, Heating, Electrical, and Housing Inspector to ensure compliance with the building and construction standards prescribed by laws of the State of Minnesota and ordinances of the city. The Building Official shall be responsible for the proper issuance of all building, construction, or occupancy permits as are required by provisions of this code. Persons may be employed on a fee basis to assist the Building Official in conducting inspections pursuant to this section.
         (a)   The Building Official shall not approve any building, construction or occupancy permit unless he has received the plans and specifications and determined that they conform to the zoning code and all applicable building and construction standards prescribed by law.
         (b)   The Building Official shall not issue any building, construction, or occupancy permit without a certification from the Zoning Administrator that all procedures for approval of plans as may be required by the zoning code have been completed and approval has been granted by the designated authority.
      (2)   The Building Official or his designated representative shall have the authority to conduct lawful inspections at a reasonable hour at any building or premises to ensure compliance with the zoning code and all applicable building and construction standards prescribed by law, or other related ordinances of the city.
      (3)   The Building Official shall have the power to order work stopped on construction, alteration or repair of buildings in the city when such work is being done in violation of any ordinance of the city governing the manner in which such work is to be conducted; in violation of the zoning code, or any building or construction standard prescribed by law; or when such work is not in conformity with the plans and specifications that were the basis for issuance of a building permit.
         (a)   An order to stop work shall be in writing and include the reasons for making such an order and the building or construction standard that is being violated, or the unauthorized variation from approved plans or specifications. The order may be presented to the work supervisor at the construction site or may be posted in a conspicuous place if no one is present.
         (b)   No person, firm or corporation may resume work after the issuance of such an order without the written authorization of the Building Official.
