(A) The owner or operator of a private pool may be required to keep such records as are specified by the Health Authority, in his discretion, in order to maintain the healthy, safe and sanitary condition of the pool.
(B) Any person seeking a proposed deviation from the standards and requirements of this chapter may apply for a variance in accordance with normal zoning procedures. Such a variance may only be granted by the Council upon a four-fifths vote of said Council and may only be granted when carrying out the strict letter of this chapter would cause an undue hardship upon the applicant.
(C) No person shall use or permit any swimming pool in the city to be used in excess of the maximum design bather load.
