§ 3.201 PUBLIC WORKS DEPARTMENT.
   (A)   The Department of Public Works is hereby created. The Department shall consist of the office of Director of Public Works, Assistant City Engineer, Public Works Superintendent, and such other internal administrative positions as are necessary and appropriate.
   (B)   The Director of Public Works shall administer the Department and supervise all officers and employees thereof.
   (C)   The Director of Public Works shall have advisory control and responsibility for construction or extension of any public way, street, sidewalk, or alley and the gutters and drains attached thereto; watermain, storm or sanitary sewer, and appurtenances thereto; the street lighting system; the traffic control system; or any other capital improvement project designated by the Council.
   (D)   The Director of Public Works shall have charge of and be responsible for the care, maintenance and operation of the city water distribution system, sanitary sewer system and disposal plant, the street lighting system, public streets and sidewalks, curbs, gutters and storm sewers, the traffic control system, the snow removal program, and the tree inspection, trimming and disposal program.
   (E)   The Director of Public Works shall supervise all real and personal property of the city not otherwise assigned to the control of another department or officer.
   (F)   The Public Works Superintendent shall act as ex-officio City Forester and coordinate a city program for the control and prevention of tree diseases with the State Commissioner of Agriculture.
      (1)   The City Forester shall recommend to the Council the details of a tree disease program in compliance with the provisions of state law and regulations of the State Commissioner of Agriculture.
      (2)   The City Forester shall supervise the tree inspectors to ensure that the objectives of the city program and the requirements of state law are carried out.
      (3)   The City Forester and certified tree inspectors shall have the authority provided by law to inspect all premises and places within the city as often as required or necessary to determine the condition of trees located on such property.
      (4)   The City Forester or the certified tree inspectors shall take such remedial action as is provided by regulations of the State Commissioner of Agriculture or by the Council whenever a diseased tree is identified, as provided in this code.
   (G)   The Public Works Director is authorized to issue a citation in lieu of arrest or continued detention to persons violating the following sections of this code, to wit:
      (1)   Section 6.301, Right-of-Way Management.
      (2)   Section 8.204, Public Nuisances Affecting Peace and Safety
