(A) Municipal liquor stores are hereby authorized to provide “off-sale” and “on-sale” intoxicating liquor and beer for the city at stores located at such suitable places in the city as the Council may determine.
(B) For purposes of this code, the terms defined in this section shall have the meaning ascribed to them:
INTOXICATED PERSON. A person who has lost control to any extent of his mental or physical faculties as a result of drinking intoxicating liquors or beer.
INTOXICATING LIQUOR and LIQUOR. Ethyl alcohol, distilled, fermented, spirituous, vinous, and malt beverages containing in excess of 3.2% by alcohol by weight.
LIQUOR STORE. An on-sale or off-sale or combination on-sale and off-sale establishment engaged in the sale of intoxicating liquor at retail, which as an incident thereof, may also sell cigars, cigarettes, ice, all forms of tobacco, beer, and soft drinks at retail. The liquor store includes an on-sale or combination on-sale and off-sale establishment operating a restaurant for selling food to be consumed on the premises.
MINOR. A person less than 21 years of age.
OFF-SALE. The sale of liquor or beer in original packages in retail stores for consumption off or away from the premises where sold.
ON-SALE. The sale of liquor or beer by the glass for consumption on the premises only.
PACKAGE or ORIGINAL PACKAGE. Any container or receptacle holding liquor, which container or receptacle is corked or sealed.
SALE, SELL and SOLD. All barters for pecuniary gain, or all manner and means of furnishing intoxicating liquor or beer in violation or evasion of law.
3.2% MALT LIQUOR or BEER. Any malt beverage with an alcoholic content of more than 0.5% by volume and not more than 3.2% by weight.
(C) The liquor store manager shall supervise and control employees assigned to him and shall ensure compliance with all applicable provisions of the law of the State of Minnesota and ordinances of the city pertaining to liquor operations.
(D) The City Manager shall designate the days and hours of operation. However, no sale of intoxicating liquor may be made at a time when such sale is prohibited by Minnesota Statute.
