§ 92.99 PENALTY.
   (A)   Any person who shall gain access to a county road from any public or private location without having first obtained a permit shall, upon conviction thereof in Municipal Court, be guilty of a misdemeanor and shall be subject to a fine in an amount of not to exceed $100 or imprisonment for not less than 30 days, and/or both fine and imprisonment as provided above. Any person convicted of a second violation of this section within a period of 12 months shall be designated as an habitual offender and shall lose the right to make application for a permit for a period of 12 months and shall further, upon conviction of a second offense within 12 months, be subject to a fine of an amount not to exceed $500 or imprisonment of not more than 90 days, and/or a fine and imprisonment.
   (B)   Any person who shall gain access to a county road without a permit shall, in addition to all penalties provided herein, be liable to the county for all damages caused to the road, including, but not limited to, the cost of materials and labor required to repair any damages caused by the unpermitted access, which damages shall be enforceable in the Circuit or Municipal Courts.
