§ 91.99 PENALTY.
   Upon conviction for violation of this subchapter, the offender shall be punished as follows:
   (A)   Upon the first conviction, violation of this subchapter shall be designated as a Class C Misdemeanor as defined by the Criminal Code of the laws of the state, and shall carry a penalty for the first violation of a fine of not more than $100, imprisonment in the County Jail for up to 30 days, or both fine and imprisonment.
   (B)   Upon the second conviction of an offense within a period of one year from the date of last conviction, the penalty for a criminal violation shall be increased to that of a Class B Misdemeanor, and the Court may sentence the violator to a fine of not more than $500, imprisonment in the County Jail for not more than 90 days, or both fine and imprisonment.
   (C)   Upon conviction for violation of this subchapter, any court of competent jurisdiction may, in addition to the penalties provided above, order the loss of privileges of the defendant for the use of the lake area for a period of up to one year, and/or sentence the defendant to perform public service work upon lake property, including, but not limited to, trash collection, public property improvement or any other type of common and usual labor required to provide routine upkeep upon the lake area.
