§ 34.11 ENVIRONMENTAL REMEDIATION FUND.
   (A)   The Environmental Remediation Fund for the City of Columbia City, Indiana is hereby established, into which all funds received by the city and the Redevelopment Commission (RDC) as a result of the mandatory cleanup of the LML Site shall be transferred.
   (B)   The city and the RDC will direct the cleanup of the LML Site and all cleanup expenses and fees shall be paid from the Environmental Remediation Fund. Such expenses and fees may include, but are not limited to, contractor fees, demolition and removal costs, and all cleanup expenses.
   (C)   At the time the RDC determines that the LML Site has been remediated sufficiently, the RDC shall petition IDEM for a "no further action" letter for the LML Site. Upon confirmation from IDEM, and any other governmental agency required to inspect and/or audit the LML Site, that the LML Site cleanup has met all necessary requirements, that the LML Site cleanup has sufficiently met environmental remediation requirements under Indiana's commercial and industrial cleanup standards, and that the LML Site is released from further inspection and/or audit, any monies remaining in the Environmental Remediation Fund shall be retained in such fund and only expended at the direction of the RDC for redevelopment purposes the RDC deems necessary.
