§ 119.04  OPERATION OF MARKET.
   In respect to the operation of the market, Whitley Farmers Market shall comply with the following requirements:
   (A)   The market shall be kept in a clean, sightly, and healthful condition, free from debris and offensive odors. The market shall be a smoke-free zone.
   (B)   A portion of the sidewalk within the area may be used for display and sales of produce as long as any obstruction would not hinder the passage of persons thereon.
   (C)   Upon the cessation of the market activities on any market day, the area shall be promptly vacated and returned to the same condition of sightliness, healthfulness, and cleanliness as existed prior to such market activity on that day.
   (D)   Whitley Farmers Market shall designate a chairman of the market who shall be the contact person with the city and its respective departments.
   (E)   Annually, Whitley Farmers Market shall submit to the Board for approval, along with proposed days and hours for the market, alternative sites upon which the market could be held on days of conflict with established city activities. The market shall not be held at its designated Chauncey Street location during the period of the Old Settlers’ Day Festival.  Whitley Farmers Market may designate other days during which the market shall not be held due to conflict with other annual or non-annual community activities.
   (F)   The city and its respective departments, officers, agents and employees shall be held harmless from any and all liability of any kind or character incurred, asserted, or alleged to have occurred as a result of activities pertaining to the market.
