§ 119.03  REGULATION OF VENDORS.
   (A)   Unless excepted below, only produce grown, gathered and produced within Whitley County and surrounding counties shall be sold at the market. The market area shall be Whitley County, Noble County, Kosciusko County, Allen County, Wabash County and Huntington County (“the produce market area”). Produce may be sold only by individuals or their immediate families who have grown, produced, or gathered the products within the confines of the produce market area.
   (B)   The term PRODUCE is defined to mean garden-grown or field-grown agricultural products such as fresh fruits, vegetables, nuts, eggs, noodles, baked goods, flowers, honey, herbs and cheese. Homemade crafts or home baked goods may be sold only upon approval of Whitley Farmers Market who shall have the final decision as to what items other than produce may be sold at the market.
   (C)   All selling shall be done from the rear of vehicles or from tables placed directly outside of the rear of vehicles. Vehicles shall be backed into the established parking spaces. No selling shall be permitted from the street side of the vehicles. No part of a vehicle shall extend more than 20 feet from the curb with measurement being taken from the curb on a perpendicular line.
   (D)   Provisions of this code applicable to itinerant vendors, to backing into parking spaces, and to parking limitations shall not be enforced with respect to participants during market hours.
