The Common Council reserves the right to award franchises on terms and conditions that may deviate from the terms and conditions of the chapter. This shall be permitted where the Common Council expressly determines that special circumstances warrant such deviations. A cable operator's use of technology or equipment affecting the public interest or public resources in substantially different ways that the chapter was designed to address, may entail such special circumstances.
