§ 53.27 METHOD OF DISPOSAL FOR DOMESTIC SOLID WASTE.
   (A)   It shall be unlawful to place or permit to remain anywhere in the city any garbage or refuse except in a container, except that refuse which is too bulky to place in a container shall be disposed of as debris.
   (B)   The owner or occupant of a unit shall dispose of domestic solid waste as follows:
      (1)   Except where the containers are provided by the city or its contractor, the owner or occupant of a unit shall provide and maintain, in good order and repair, garbage or trash receptacles of sufficient number to contain the domestic solid waste that will accumulate on the premises.
      (2)   Except where the containers are provided by the city or its contractor, containers shall be of a durable grade of galvanized metal or other suitable material approved by the Board of Public Works and Safety of not greater than 32-gallon capacity. They should be provided with two lifting handles on opposite sides. The containers shall be without inside protrusions, and all the refuse shall be loosely packed or in bags so that the contents shall discharge freely when the receptacle is inverted.
      (3)   Containers, except those provided by the city, loaded and placed for pick-up shall not weigh in excess of 55 pounds and shall not exceed two containers in number per week.
      (4)   Receptacles which have deteriorated, or have been damaged to the extent that they are no longer suitable for their intended purpose, or those having jagged or sharp edges capable of causing injury to refuse collectors or other persons whose duty it is to handle such containers, are hereby declared a nuisance and shall be condemned by the city. If such receptacles are not removed within five days after notice of such defective condition to the owner or user, then such receptacles may be confiscated by the city or its contractor. Whenever city provided receptacles or totes fall under the concerns of this division (B)(4), the owner of the property shall be responsible for replacement of the receptacle or tote, and the cost thereof. In the event the owner of the property, its designee or renter, shall not pay such costs to the city within the time designated by the city in written notice to the owner, the city may pursue collection thereof, including attorneys' fees and court costs.
      (5)   The Board of Public Works and Safety shall designate from time to time the point at which owners, occupants, tenants or lessees shall place their domestic solid waste for regular collection service. For those owners, occupants, tenants or lessees who have difficulty in complying with the designated point for collection service, the Board of Public Works and Safety shall determine the point for such owner, occupant, tenant or lessee which will be the most accessible for their domestic solid waste collection and removal. When alleys or streets become impassable because of inclement weather or other unusual conditions, the city may notify owners or occupants of units to place refuse receptacles at the nearest collection point which is accessible and acceptable to refuse removal vehicles.
      (6)   Solid waste disposal containers and recycling containers intended for collection shall be placed by the owner or occupant of the unit at the collection point no earlier than 7:00 p.m. of the day proceeding the collection and no later than 6:00 a.m. on the day of collection. Such containers shall be removed from the collection point after collection by 7:00 p.m. on the day of collection.
