§ 53.06 ACCUMULATIONS A NUISANCE.
   Any mess or accumulation of garbage, refuse, and natural debris, other than natural debris deposited by the wind and natural forces, on any property within the city in violation of this chapter is declared to be nuisance, and the owner or occupant of the property on which such nuisance is found shall be ordered by the Board of Public Works and Safety or its designee to abate the same not later than a date to be stated in a written notice ordering such abatement, and in no case less than five days. On failure of the occupant to abate said nuisance, the Board of Public Works and Safety or its designee may enter on the premises and abate the same, the costs of which shall be assessed against the owner of the property, and if not paid within 30 days after notification thereof, the city may impose a lien on such property for the expense, and shall place the same on the tax duplicate in the office of the Treasurer of Whitley County, Indiana, for collection as provided by law.
