§ 32.130 ESTABLISHMENT.
   (A)   There is established pursuant to I.C. 36-4-9-5 and I.C. 36-4-9-8 a Board of Public Works and Safety within the Executive Branch. Such Board shall be the chief administrative body of the city and shall have statutory jurisdiction over the following executive departments:
      (1)   Police Department;
      (2)   Fire Department;
      (3)   Utilities Departments (including Electric, Water, Wastewater, and Sewage Collection and Disposal);
      (4)   Street Department; and
      (5)   Stormwater, including collection, disposal, drainage of storm and surface water through the city's stormwater system, as governed by I.C. 8-1.5-5 et seq., (the “Stormwater Act”).
   (B)   The following departments shall also report to the Board as applicable or upon request:
      (1)   Communications; and
      (2)   Parks and Recreation (as applicable outside of the Park Department's Board's powers and duties).
   (C)   The Board of Public Works and Safety shall perform all powers and duties as prescribed by the statutes of the state of Indiana.
