6-5-16: PROCEDURE FOLLOWED IN TREES THAT REQUIRE PRUNING OR REMOVAL:
   A.   Notice To Prune Or Remove: For any person or persons owning real property bordering any street who fails to prune or remove a tree in violation of section 6-5-15 of this chapter, the city shall order such a person or persons within ten (10) days after written receipt or written notice to prune or remove such trees. The order may be served by personal service, certified mail or publication to the last known address of the property owner.
   B.   Order Requiring Hearing: The order shall herein be served by mailing a copy of the order to the last known address of the property owner by certified mail.
   C.   Hearing: In the event the property owner disagrees with the order, the property owner may request a hearing before the city council of Colstrip. Such written request for hearing must be filed within fifteen (15) days from the receipt of the order. This provision should not be construed to limit the liability of the property owner that may be incurred for maintaining a dangerous or diseased tree. This hearing should be held at the first council meeting, after the request, allowing for sufficient time for the matter to be placed on the agenda.
   D.   Failure To Comply: When a person to whom an order is directed shall fail to comply within the specified time, it shall be lawful for the city to prune or remove such tree, and the exact cost plus administrative expenses thereof shall be assessed to the owner as provided for by law in the case of special assessments.
