The permittee shall be responsible for any and all damages to property or injury to persons arising out of the exercise of the permit. The permittee shall indemnify and hold harmless the City and all its officers, agents and employees from all suits, actions or claims of any character, name and description brought for or on account of any injuries or damages received or sustained by any person or property due to the exercise of the permit or of any action or omission of the permittee, the Manager's agents or employees or on account of the failure of the permittee to maintain or to provide necessary safety devices to ensure the safety of the public. The permittee shall defend against any suit, action or claim and pay any judgment, with costs, which may be obtained against the City, its officers, agents or employees growing out of the claimed injury or damage.
