4.3.102: APPLICATION AND ISSUANCE:
   A.   Any person desiring a temporary park permit shall apply to the Manager at least ninety (90) days prior to the date of the intended use on forms provided by the Manager.
   B.   The Manager may issue a temporary permit upon the following conditions:
      1.   That the proposed use will not unreasonably interfere with or detract from the general public enjoyment of the park.
      2.   That the proposed use will not unreasonably interfere or detract from the promotion or protection of the public health, welfare and safety.
      3.   That the proposed use is not reasonably anticipated to lead to or incite violence, crime, disorderly conduct or injury or damage to park land, park property, facilities or patrons.
      4.   That the proposed use will not entail extraordinary expense to the Department or to the City.
      5.   That the park in whole or part has not been previously reserved for another use at the same date and time requested in the application.
      6.   Applicant has paid the appropriate fee established by the Department.
   C.   The Manager may submit any temporary park permit application to the Board for its recommendation. The Manager's or Board's decision regarding the application shall be final. (Ord. 4716; 1968 Code §§10-8, 10-9; Ord. 01-42)
