The Council hereby finds and determines that it will provide for development review to ensure compliance with City land use regulations by conducting a review of all required building permits by means of the City's development review enterprise in conformity with all applicable Colorado laws. The enterprise will be a financially self-sufficient organization supported by the fees it collects. The Council further: a) recognizes and confirms that the enterprise is an "enterprise" within the meaning of TABOR and within City Charter section 7-90, and b) declares its intent that the enterprise be operated and maintained so as to exclude its activities from the application of TABOR and City Charter section 7-90. Therefore, Council hereby creates the "City Of Colorado Springs Development Review Enterprise". The City shall take all actions on behalf of the enterprise as provided below.
