9-7-4: DESIGNATION AND APPLICABILITY:
The city of Colona shall designate certain areas to allow wireless communication facilities. Said areas shall be determined from time to time by the city council and be in accordance with the zoning code and comprehensive plan of the city of Colona and any statutes that may apply. Facilities requiring support structures may not be permitted within the same location as those without support structures.
   A.   Permit Required: No person, firm or corporation shall install or construct any wireless communication facility unless and until a tower use permit (TUP) has been issued pursuant to the requirements of this chapter.
   B.   Preexisting Wireless Communication Facility: Wireless communications facilities for which a permit has been issued prior to the effective date hereof shall be considered nonconforming and shall be required to meet the requirements of this chapter.
   C.   Amateur Radio Exclusion: This chapter shall not govern the installation of any amateur radio facility that is owned and operated by a federally licensed amateur radio station operator or is used exclusively for "receive only" antennas. Such installations shall comply with any other applicable provisions of the zoning ordinance.
   D.   Relationship To Other Ordinances: This chapter shall supersede all conflicting requirements of other ordinances regarding the locating and permitting of wireless communication facilities.
   E.   Building Codes: Construction of all wireless communication facilities shall comply with the requirements of the city of Colona building code and permitting process in addition to the requirements of this chapter. (Ord. 15-01, 9-10-2001)
