9-5-10: FENCES:
   A.   Fence Required: All outdoor swimming pools having a water depth of three feet (3') or more shall be completely enclosed by a fence. In determining if a pool has three feet (3') depth the manufacturer's established stated depth for the facility shall be conclusive of the pool's considered depth for water, notwithstanding any measured active depth at any given time.    B.   Gates: All fence openings or points of entry into pool area enclosure shall be equipped with gates. All gates shall be equipped with self-closing and self-latching devices placed at the top of the gate. (1997 Code)
   C.   Specifications: The fence and gates shall not be less than four (4) or more than six feet (6') in height above the grade level and shall be constructed of a minimum number of gauge woven wire mesh, corrosion resistant material or similar material. However, a private swimming pool fence may be constructed of treated CCA cedar or redwood. (Ord. 0-10-10, 11-9-2009)
   D.   Fence Posts: Fence posts shall be decay or corrosion resistant and shall be set in concrete bases.
   E.   Maintenance: All fences shall be maintained in a safe condition. (1997 Code)
   F.   Acceptable Enclosures: Pool enclosures which are attached to the top of the pool, according to the manufacturer's recommendations, and which have a locking gate will be considered an acceptable enclosure. This will only be considered an acceptable enclosure as long as any stairs going up to the pool are removed or have a locking gate at the bottom of the entrance to the stairs accessing the pool.
