5-2-2-2: DISTURBING THE PEACE:
   A.   Definitions: As used in this Section, the following words and terms shall have the meanings ascribed to them in this subsection:
    LOUD, UNUSUAL NOISES: The playing of music at such volume that the activities of another are being disturbed; or shouting, screaming such that the activities of another are being disturbed; or in any manner creating such volume of noise not pertaining to the maintenance or utility of the premises that disturbs the activities of another.
   PRINCIPAL ADULT OCCUPANTS: The owner or lessor or the premises or the person or persons who maintain the premises and reside at such premises.
   B.   It shall be unlawful for the principal adult occupants of any residence to allow their premises to be used by any person, whether a resident of the premises or a guest or visitor; to wilfully, maliciously and intentionally disturb the peace and quiet of another or of a neighbor or family or religious congregation or other assembly by loud, unusual noises.
   C.   It shall be unlawful for any person to wilfully, maliciously and intentionally disturb the peace and quiet of another or of any neighbor, family, religious congregation or other assembly by indecent behavior or by offensive or unbecoming conduct to threaten, quarrel, fight, provoke an assault or battery, or to curse, swear or utter obscene, vulgar, or indecent language offensive to another in their presence when they are lawfully upon their property or upon a public place.    D.   Engine Idling: No person operating a motor vehicle with a gross vehicle weight rating of eight thousand (8,000) pounds or more, including but not limited to a refrigerated motor vehicle or trailer, or who owns or leases the property upon which such motor vehicle or trailer is located, shall cause or allow that motor vehicle, when it is not in motion, to idle between the hours off 10 pm to 6 am or otherwise cause or allow the main engine or any refrigeration unit of the motor vehicle to operate when parked or standing if the motor vehicle is located in a residential area or within one hundred (100) feet of a residential area, except under the following circumstances:
      1.   A sound wall exists between the property upon which the motor vehicle is located and the residential area;
      2.   The motor vehicle is a school bus;
      3.   The motor vehicle is a waste hauling vehicle;
      4.   For the purposes of loading and unloading the vehicle for the minimum period of time necessary for said loading and unloading, nor shall it apply to a commercial vehicle enclosed within a building or private property;
      5.   A police, fire, ambulance, public safety, other emergency or law enforcement motor vehicle or any motor vehicle used in an emergency capacity, idles while in an emergency or training mode and not for the convenience of the vehicle operator;
      6.   The motor vehicle is owned or operated by a Federal, State, or local governmental agency;
      7.   The motor vehicle is owned by an electric utility and is operated for electricity generation or hydraulic pressure to power equipment necessary in the restoration, repair, modification, or installation of a utility service;
      8.   The motor vehicle is owned by a public utility and operated to power equipment necessary in the restoration, repair, modification, or installation of a utility service;
      9.   The motor vehicle idles while forced to remain motionless because of on-highway traffic, an official traffic control device or signal, or at the direction of a law enforcement official;
      10.   The motor vehicle idles when operating defrosters, heaters, air conditioners, or other equipment solely to prevent a safety or health emergency and there is no other alternative location that is not within one hundred (100) feet of a residential area to locate the motor vehicle;
      11.   The motor vehicle idles as part of a government inspection to verify that all equipment is in good working order, provided idling is required as part of the inspection;
      12.   When the motor vehicle idles due to mechanical difficulties over which the operator has no control;
      13.   An armored motor vehicle when a person remains inside the vehicle to guard the contents, or while the vehicle is being loaded or unloaded;
      14.   A bus idles a maximum of fifteen (15) minutes in any sixty-minute period to maintain passenger comfort while non-driver passengers are on board;
      15.   The motor vehicle is (i) a bus owned by a public transit authority and (ii) being operated on a designated bus route or on a street or highway between designated bus routes for the provision of public transportation. (1997 Code; amd. Ord. O-23-05; 4-24-2023)
