4-3-8: FEE COLLECTION PROCEDURES:
There is hereby established and the City shall impose, collect and enforce a schedule of mandatory fees for solid waste collection services as follows:
   A.   Residential Dwelling Units: Residential dwelling units will be charged as a single-family rate per dwelling unit per month.
   B.   Deposit: There shall be no customer deposit to renters that have the service in their name.
   C.   Statements: Charges for garbage disposal service shall be billed, dated and sent out on the water-sewer bills, but shall be maintained in a separate account. Billing for garbage disposal service shall be on the water-sewer bill issued immediately prior to that month's disposal service. (1997 Code)
   D.   Delinquent Accounts: Bills for service shall be rendered monthly and shall be considered delinquent twenty (20) days after their rendition. In the event of failure to pay the bills within the twenty (20) day period, an additional charge of ten percent (10%) of the present bill shall be added as a late payment penalty to arrive at the total bill for refuse with delinquency charges.       1.   Collection; Lien: If an account is delinquent for sixty (60) days, the City Clerk shall be authorized and directed to institute legal proceedings, in the name of the City, to collect the delinquent account or place a lien against the premises for nonpayment of services or effectuate any other remedy provided by law to collect any such delinquencies.
      2.   Costs Of Collection: Users of the service and the owner of the subject real estate shall be liable for all costs associated with the collection action including reasonable attorney fees.
      3.   Notice To Owner: Failure of the City Clerk or Collector to mail the notice to the owner of the premises, if the owner is different than the occupant or user of the garbage collection service, or the failure of the owner to receive the notice shall not affect the right to foreclose the lien for unpaid bills as mentioned in the foregoing subsections.
      4.   Release Of Lien: If the City shall have filed the statement of lien claim with the County Recorder of Deeds, then before the City will execute and file a release of the lien claim with the County Recorder of Deeds, there shall be paid to the City Collector or Clerk all outstanding amounts plus eighteen percent (18%) per year interest on the principal amount due to the City plus a sum sufficient to cover the City's expenses in recording and releasing the lien claim and payment of the City's attorney fees, if any.
   E.   Termination Of Service:
      1.   Notice Of Termination: Any user requesting a termination of service shall give written notice to the City ten (10) days prior to the time such termination of service is desired. (1997 Code)
      2.   Temporary Discontinuation: If the dwelling is vacant more than ninety (90) days and will continue to be vacant, a temporary vacant discontinuation of service may be applied for by submitting the proper form to the City Clerk or Collector. If any usage of sewer or water is found on the account during that time, discontinuation will cease and service will be charged beginning with the month usage begins. If a property will be vacant from three (3) months to six (6) months and the property owner(s) reside at that property, a property owner may apply for temporary vacation discontinuation of service during this time on the form supplied by City Hall, and it will be submitted for approval to the City Clerk. If any usage of sewer or water is found on the account during that time, discontinuation will cease and service will be charged for each month that was suspended. Discontinuation of service less than three (3) consecutive months and more than six (6) consecutive months is not allowed under the vacation rate. (Ord. 0-17-12, 7-24-2017)
      3.   Responsibility For Payment: Responsibility for payment of services prior to the date of termination shall be with the owner of the premises. No penalty or past due bills shall be charged for transferring the service to subsequent users.
   F.   Refunds: The City Collector or Clerk is authorized and directed to refund the unused portion of a fee paid in advance.
   G.   Separate Account: The City Clerk is authorized to establish a separate account to receive funds herein and to pay the proper and authorized contractor pursuant to contract as entered into by the City.
   H.   Rate; Administration Fee: The rate charged each unit shall be set from time to time by the Council, over and above the per unit charge by the contractor. Such fee is to cover costs of administering the accounts by the City. (1997 Code)
