§ 91.40 UNLAWFUL PRACTICES.
   It shall be unlawful for any person, firm or corporation to sell or offer for sale any type of fireworks (as defined in Tenn. Code Ann. § 68-104-108) or toy cannons within the corporation except sparklers, toy pistols or caps or like fireworks that can be fired or used within a room. It shall be unlawful to fire or light any fireworks upon the streets of the corporation or within the open lots near any business, house or residence within the corporation.
   (A)   Due to public safety concerns, public complaints, limited areas for these types of events, and the taxing availability of manpower that must be provided by the Fire Department, outdoor fireworks displays, that also include close proximity displays, sky lanterns, kites etc., shall not be permitted within the Town Limits unless approved by the Board of Mayor and Alderman.
   (B)   All approved outside public fireworks displays shall be permitted through the State of Tennessee Fire Marshal's Office as defined in Tenn. Code Ann. § 68-104.
   (C)   All approved indoor and outdoor fireworks displays shall also obtain a permit from the Collierville Fire Marshal's office.
