§ 91.15 FIRE CODE ADOPTED.
   (A)   Pursuant to the authority granted by Tenn. Code Ann. § 6-54-502, and for the purpose of prescribing regulations governing conditions hazardous to life and property from fire and explosion, the International Fire Code 2018 Edition to include Appendix B, Appendix C and Appendix D, as recommended by the International Code Council and NFPA 101: Life Safety Code, 2018 Edition is adopted by reference included herein as a part of this code. Pursuant to the requirements of Tenn. Code Ann. § 6-54-502, one copy of the International Fire Code 2018 Edition has been filed with the Town Clerk and is available for public use and inspection. The Fire Code is adopted and incorporated as fully as if set out at length herein and shall be controlling within the corporate limits of the Town of Collierville.
   (B)   The 2018 International Fire Code is amended and changed in the following respects:
      (1)   Amend Appendix D Section D106.1: Projects having more than 50 dwelling units. Multiple-family residential projects having more than 50 dwelling units shall be equipped throughout with two separate and approved fire apparatus access roads;
      (1a)   Exception. Delete this entire section.
      (2)   Appendix D Section D107.1: One or two family residential developments. Developments of one or two family dwellings where the number of dwelling units exceeds 50 shall be provided with two separate and approved fire apparatus access roads.
      (2a)   Amend Section D107.2: Remoteness. Where two fire apparatus access roads are required, they shall be placed a distance apart equal to not less than one-half of the length of the maximum overall diagonal dimension of the property or area to be served, measured in a straight line between accesses. In the event topography will not allow for intent of this section to be met the minimum remote distance shall meet the requirements found in Town of Collierville subdivision regulations.
      (3)   Hazardous materials placards vehicles as governed in § 91.19 shall remain in place and be an exception to International Fire Code and NFPA references and standards;
      (4)   Automatic sprinkler system requirements as governed in § 91.21 shall remain in place and where it conflicts with the International Fire Code or any other standards of the International Building or Residential Code or NFPA.
      (5)   Amend Section 303.4: Attendant. An operating kettle shall be attended by a minimum of one employee knowledgeable of the operations and hazards. The employee shall be within 25 feet of the kettle and have the kettle in sight. Ladders or similar obstacles shall not form a part of the route between the attendant and the kettle.
      (6)   Amend Section 307: Open Burning, Recreational Fires and Portable Outdoor Fire Places. These amendments are intended to promote the public health, safety and welfare and to safeguard the health, comfort, living conditions, safety and welfare of the citizens of the Town of Collierville, Tennessee by regulating air pollution and fire hazards of outdoor burning.
      (6a)   Amend Section 307.1: General. A person shall not kindle or maintain or authorize to be kindled or maintained any open burning unless conducted and approved in accordance with §§ 307.1.1 through 307.5 and all requirements established for open burning found in the Shelby County Health Department's Air Pollution Control requirements adopted by reference by the Town of Collierville and found in Chapter 96 of the Town's Ordinances.
      (7)   Amend Section 307.1.1: Prohibited Open Burning. Open burning shall be prohibited within the Town Limits of Collierville. No person shall cause, suffer, allow or permit open burning of refuse, garbage, trade waste, trees, limbs, brush, grass clippings, leaves, agriculture stubble, or materials from salvage operations, in accordance with this section and Town of Collierville Ordinances, Chapter 96.
         EXCEPTION:
            1)   This section does not apply to grilling, barbeque, or cooking food using charcoal, wood, propane or natural gas in cooking or grilling appliances.
            2)   This section does not apply to burning for the purpose of generating heat in a stove, furnace, fireplace or other heating device within a building used for human or animal habitation.
            3)   This section does not apply to fires used for training and instruction of firefighters or for research in fire protection or prevention.
            4)   This section does not apply to recreational fires as outlined in section 307.4.2.
            5)   This section does not apply to portable or fixed outdoor fireplaces as outlined in section 307.4.3.
      (7a)   Add New Section 307.1.2: Agriculture Burning. Burning of agriculture land and fields for the purpose of clearing trees, limbs, brush grass, weeds, crop stubble and demolition waste that may be on site, is prohibited within the Town Limits of Collierville, Tennessee.
      (7b)   Amend Section 307.2.1: Authorization. Where required by state or local law or regulations, open burning shall only be permitted with prior approval from the Shelby County Health Department Pollution Control, and the Collierville Fire Department provided all conditions specified in the authorization are followed:
         1)   Land clearing for construction using controlled open burning with an Air Curtain Destructor (Blower) as outlined in the Rules and Regulations of the Shelby County Health Department Pollution Control is allowed on a case by case basis with permits and approval from the Shelby County Health Department Pollution Control and the Collierville Fire Department.
         2)   The Collierville Fire Department maintains the authority to revoke the issued permit for failure to follow requirements set out in the permit or substantiated complaints regarding excessive smoke or fly ash.
      (8)   Delete Section 307.4.1 Bonfires. Delete this entire section.
      (8a)   Amend Section 307.4.2: Recreational Fires. Recreational fires shall not be conducted within 25 feet of a structure or combustible material. Conditions which could cause a fire to spread within 25 feet of a structure shall be eliminated prior to ignition.
         1)   Shall not burn if atmospheric conditions are not favorable, if complaints are received fires shall be extinguished.
         2)   Shall not burn when drought conditions are declared, or burn bans ordered by federal, state, county or the Town of Collierville.
         3)   Shall not overload pit or fire area; keep fires small within the limits of the pit or portable fire box, not more than three feet wide and two feet in height.
         4)   Do not use flammable or combustible liquids to start fires.
      (8b)   Amend Section 307.4.3: Portable or Fixed Outdoor Fireplaces. Portable or fixed outdoor fireplaces shall be used in accordance with the manufacturer's instructions and shall not be operated within 15 feet of a structure or combustible materials.
         EXCEPTION: Portable or fixed outdoor fireplaces used at one-and two-family dwellings; except as noted below;
            1)   Shall not burn if atmospheric conditions are not favorable, if complaints are received fire shall be extinguished.
            2)   Shall not burn when drought conditions are declared, or burn bans ordered by federal, state, county or the Town of Collierville.
            3)   Fuel burned in the outdoor fireplace shall be clean wood, wood pellets made from clean wood, or other listed fuels specifically permitted by or per the manufacturers instruction.
            4)   Trash, yard waste, rubbish, or paper products shall not be burned.
      (8c)   Amend Section 307.5: ATTENDANCE. Open burning, recreational fires and use of portable or fixed outdoor fireplaces shall be constantly attended by an adult at least 18 years of age until the fire is extinguished. A minimum of one portable fire extinguisher complying with section 906 with a minimum 4A rating or other approved on-site fire extinguishing equipment, such as dirt, sand, water barrel, garden hose or water truck, shall be available for immediate utilization.
      (9)   Educational facilities shall be inspected in accordance with the shared state program under the adopted State Fire Code, which may differ from the International Fire Code.
      (10)   Amend Section 405.2 Frequency of Emergency Evacuation Drills. Required emergency evacuation drills shall be held at intervals specified in table 405.2 and in accordance with Tenn. Code Ann. § 68-102-137.
      (11)   Amend Section 403.5.1. The first emergency evacuation drill of each school year shall be conducted within the first 30 days of operation in accordance with Tenn. Code Ann. § 68-102-137.
      (12)   Section 403.8.1 Group 1-1 shall be modified to be in compliance with Tenn. Code Ann. § 68-102-137.
      (13)   Section 403.8.2 Group 1-2 shall be modified to be in compliance with Tenn. Code Ann. § 68-102-137.
      (14)   Section 403.8.3 Group 1-3 shall be modified to be in compliance with Tenn. Code Ann. § 68-102-137.
      (15)   Amend Section 503.6: Security Gates. The installation of security gates across a fire apparatus access road shall be approved by the Fire Chief or his or her designee. Where gates are installed, they shall have an approved means of emergency operation. The security gates and emergency operations shall be maintained operational at all times. Electric gate operators, where provided shall be listed in accordance with UL 325. Gates intended for automatic operation shall be designed, constructed and installed to comply with requirements of ASTM F 2200. All automatic gates shall be installed and meet requirements of Tenn. Code Ann. § 13-8-105.
      (16)   Fire lane requirements as governed in § 91.21 shall remain in place and where it conflicts with 503 and Appendix D of the International Fire Code the more stringent shall apply.
      (17)   Section 507.4: Water Supply Test. The fire code official shall be notified prior to the water supply test. Water supply tests shall be witnessed by the fire code official, Town of Collierville Water Department or approved documentation of the test shall be provided to the fire code official prior to final approval of the water supply system. All water flows for fire protection design purposes shall only be valid for a period of six months from the date of the last test.
      (18)   Section 507.5.1: Fire Hydrant Systems where Required. Delete Exceptions 1 and 2 in their entirety.
      (19)   Amend Section 901.4.3: Fire Areas. Where buildings, or portions thereof, are divided into fire areas so as not to exceed the limits established for requiring a fire protection system with this chapter or Town of Collierville § 91.21 , such fire areas shall be separated by fire barriers in accordance with the most stringent of either the International Building Code or § 91.21 (F).
      Exception: Group R Occupancies. Fire areas as described in § 91.21(F) shall not apply.
      (20)   Section 903.1: General. Automatic sprinkler systems shall comply with this section and § 91.21 and where there is a conflict between the International Fire Code, International Building Code, International Residential Code or any NFPA requirements, the most stringent shall apply unless modified herein.
      (21)   Section 903.2.1.1 Group A-1. #1 3,500 sf.
      (22)   Section 903.2.1.2 Group A-2. #2 3,500 sf.
      (23)   Section 903.2.1.3 Group A-3. #3 3,500 sf.
      (24)   Section 903.2.1.4 Group A-4. #4 3,500 sf.
      (25)   Section 903.2.3 Group E. Throughout all Group E fire areas.

      (26)   Section 903.2.4 Group F-1. A Group F-1 fire area exceeds 3,500 square feet.

      (28)   Section 903.2.7 Group M. A Group M fire area exceeds 3,500 square feet.
      (29)   Section 903.2.8 Group R. An automatic sprinkler system installed in accordance with section 903.3 shall be provided throughout all buildings with a Group R fire area as described in § 91.21(A)(4) and (5).
      (30)   Section 903.2.9 Group S-1. A Group S-1 fire area exceeds 3,500 square feet.
      (31)   Section 903.2.9.1: Repair Garages. A Group S-1 fire area used for the repair of commercial trucks or buses where the fire area exceeds 3,500 square feet.
      (32)   Fire Alarm requirements as governed in § 91.21(J)(1) through (6) shall remain in place and where it conflicts with Chapter 9 of the International Fire Code the more stringent shall apply, unless modified herein.
      (33)   Amend Section 907.3.1: Duct Smoke Detectors. When duct detection is required per the International Mechanical Code in the main return air plenum, duct detection shall also be required in the main supply air stream of the subsequent system.
         Amend exception #1- Duct detection shall be signaled as an alarm.
      (34)   Section 907.2. 22: Battery Room. An approved smoke detection system shall be installed in areas containing stationary lead-acid battery systems having a liquid capacity of more than 50 gallons. The detection system shall be supervised by an approved central proprietary or remote station service or local alarm which will sound an audible signal at a constantly attended location.
      (35)   Section 912.2.1: Visible Location. Fire Department connections shall be located on the street side of buildings, fully visible, with an approved audible/visual device, located above the FDC and recognizable from the street or nearest point of Fire Department vehicle access or as otherwise approved by the Fire Chief.
      (36)   Section 914.6 Stages.
      (36a)   Section 914.6.1. Exception # 1, delete this entire section.
      (36b)   Section 914.6.1. Exception # 2, deleted this entire section.
   (C)   Be it further ordained that the provisions of any ordinance or regulations or parts thereof in conflict herewith are hereby repealed.
