(A) Any user affected by any decision, action or determination, including cease and desist orders, made by the Town, interpreting or implementing the provision of this code or in any permit or agreement issued herein may file with the control authority a written request for reconsideration within 60 days of such decision, action or determination setting forth in detail the facts supporting the user’s request for reconsideration; provided, however, that the appeals process established in § 53.10 herein shall apply for purposes of pretreatment enforcement.
(B) (1) For the purpose of appeals, a three-part hierarchy shall, in ascending order, consist of:
(a) Director of Public Services;
(b) Town Administrator; and
(c) The Board of Mayor and Aldermen.
(2) Any appeal will be heard within 30 days from receipt of the notice of appeal. A decision will be made not more than 15 days after the appeal is heard at each level.
