(A) In accordance with the Clean Water Act, 33 U.S.C 1251 et seq., and the provisions of the code of federal regulations applicable thereto, which required the Town to implement a wastewater treatment users charge, where each user will pay its proportionate share of the cost for operation and maintenance of the total treatment works. Direct and incidental cost to the Town, including, but not limited to administrative, technical and legal expenses shall be considered a part of the operations and maintenance of the total treatment works. There shall be five types of charges: the first type of charge is a customer service charge; the second type of charge is a monthly base rate charge; the third type is a volumetric charge; the fourth is a charge for treating wastewater which has an excessive strength; and the fifth is a charge to industry to recover that portion of federal funds expended on projects which benefit or serve industry.
(B) All sewer service shall be furnished to customers according to the following schedule of rates. The Town shall begin collecting the rates shown below with the monthly bills sent to the Town’s sewer customers in February of each year. The Town shall charge customers the applicable amount within each of the following categories of charges: (1) the customer service charge; (2) the base rate charge; and (3) the volumetric charge; (4) the additional treatment cost charge; and (5) the industrial cost recovery charge as follows:
(1) Sewer customer service charge. Certain sewage expenditures or a portion of certain expenditures are incurred regardless of the use of the treatment system and, therefore, a portion of these costs will be recovered through a monthly customer service charge.

(4) Additional treatment cost. In addition to the base rate revenue per customer charge and the volumetric charge, any user who discharges wastewater with a strength greater than domestic sewage (BOD - 250 mg/l, T.S.S. - 225 mg/l) will be assessed an additional treatment charge (ATC) based on the following formulas:

(5) Nonrefundable fee for application for a new or reissuance of a wastewater discharge permit.
(6) (a) Special charges for Cotton Creek and Spring Creek Ranch. Users of sewer service furnished by the Town, who (i) are situated outside the municipal limits of the Town in the areas of Cotton Creek and Spring Creek Ranch subdivisions, (ii) start to receive in the first instance sewer service from the Town, and (iii) are billed for such Town sewer service by the Memphis Light, Gas and Water Division of the City of Memphis (“MLGW”), shall pay, in addition to the monthly customer service charge for sewer expenditures in effect for the Town from time to time and any other “outside the City” fees or charges of the Town in effect from time to time which are applicable for sewer and related services, a fee equal to the contracted administrative fee being required by MLGW to bill such users for such services.
(b) Charges for unmetered Cotton Creek (including Kirkland Estates) and Spring Creek Ranch customers. Sewer service furnished by the Town of Collierville for customers situated outside the municipal limits of the Town and within the Cotton Creek and Spring Creek Ranch subdivisions that do not have metered water service shall be charged a monthly rate of $58.54.
(C) The control authority shall institute an accounting system reflecting an equal distribution of total funds produced under the code based upon the respective needs of each segment of the wastewater treatment operations and maintenance functions, including and not limited to, plant operations, sewer maintenance, sewer design, sewer construction, pollution control monitoring, wastewater treatment capital improvements bond indebtedness, direct and incidental cost to the Town, including, but not limited to, administrative, technical and legal expenses and other expenditures necessary for an effective wastewater treatment program. Revenue generated under this code shall be used exclusively for the wastewater treatment program.
(D) Review of system. The user charge system shall be reviewed annually and revised periodically as required in order to generate sufficient revenue to pay for the cost of operation, maintenance and replacement of equipment of the wastewater treatment system.
