§ 37.136 COMPUTATION OF FIRE FACILITIES FEE.
   (A)   One and two family dwellings. The fire fee schedule shall be calculated at $.15 per gross heated square foot of floor area for the first 3,500 gross heated square feet and $.30 per gross heated square foot of floor area above 3,500 gross heated square feet up to 5,500 gross heated square feet.
   (B)   Multi-family dwellings/apartments. The fire fee schedule shall be calculated at $300 per dwelling unit for all dwelling units within a multi-family dwelling or apartment.
   (C)   All other buildings. Except as set forth in divisions (A) and (B) of this section, the fire fee schedule for the gross square footage for the first two floors of all buildings shall be calculated as follows:
      (1)   All buildings with gross square footage of up to 3,500 gross square feet shall pay a fire fee of $.30 per gross square foot for the first 3,500 gross square feet;
      (2)   All buildings that are between 3,501 gross square feet and 50,000 gross square feet shall pay the fee set forth in division (C)(1) of this section for the first 3,500 gross square feet and a fee of $.06 per gross square foot for each gross square foot between 3,501 and 50,000 gross square feet;
      (3)   All buildings that are between 50,001 and 100,000 gross square feet shall pay the fee set forth in division (C)(1) of this section for the first 3,500 gross square feet, the fee set forth in division (C)(2) of this section for each gross square foot between 3,501 gross square feet and 50,000 gross square feet, and a fee of $.03 per gross square foot for each gross square foot between 50,001 gross square feet and 100,000 gross square feet;
      (4)   All buildings over 100,000 gross square feet shall pay the fee set forth in division(C)(1) of this section for the first 3,500 gross square feet, the fee set forth in division(C)(2) of this section for each gross square foot between 3,501 gross square feet and 50,000 gross square feet, the fee set forth in division(C)(3) of this section for each gross square foot between 50,001 gross square feet and 100,000 gross square feet, and a fee of $.01 per gross square foot for each gross square foot over 100,001 gross square feet;
      (5)   The maximum fire fee that shall be charged for a single floor of any building shall be $7,500;
      (6)   Persons receiving a building permit(s) to develop property that is part of a master development plan, including, but not limited to strip malls, shall be charged a fee per gross square foot of floor area only for that portion of the property for which the person receives a building permit. If improvements are later construction such property to accommodate specific uses, no fire fee shall be payable incident to the issuance of a building permit relating thereto;
      (7)   When a master development plan includes a common area that is covered and fully enclosed, persons receiving building permits to develop property that is part of the master development plan shall, in addition to the fees set forth in subsections (1) through (4), be assessed a fire fee for the common area. The amount of the common area fee shall be at the rates set forth herein and shall be calculated based upon the percentage of property within the entire master development plan for which the person receives a building permit in relation to the entire gross square footage of the master development plan.
   (D)   Structures with stories above a second floor. Beginning with the third floor and each additional floor of all buildings, except multi-family dwellings/apartments, the fire fee shall be calculated at $.15 per gross square foot. The maximum fire fee per floor shall not exceed $7,500.
   (E)   Fire fees. All funds collected pursuant to this subchapter shall be properly identified as fire fees and accounted for separately as determined by this chapter and used solely for the purpose specified herein.
