SECTION 4.05 POWERS AND DUTIES OF THE MANAGER
The Manager shall be responsible to, and accountable to the Council as a whole for the administration of the Village. The Manager shall be the chief administrative officer of the Village and shall have the following powers and duties.
A.   When deemed necessary, the Manager may suspend, remove, or otherwise discipline all department heads appointed by the Manager, except as provided by, or pursuant to, this Charter.
B.   The Manager shall have the power to appoint, with the input of the Mayor and with the approval of Council, any department heads as approved by Council, and subject to the provisions of the Charter.
C.   The Manager shall be the Personnel Officer, and, as such is responsible for the administration of each department, office, and agency including the appointing of, suspending, removing, or otherwise disciplining all municipal employees, except as otherwise provided by or under this Charter, subject to the provisions of Article IX. Such personnel actions shall be in accordance with the personnel code of the Village.
D.   The Manager shall attend all Council meetings and shall have the right to take part in discussions, but may not vote.
E.   The Manager shall see that all laws, provisions of this Charter, and ordinances and resolutions of the Council, imposing duties on the Manager or employees subject to the Manager's direction and supervision, are faithfully executed. Failure of the Manager to execute all provisions of this Charter and other laws of this Village shall result in the actions specified in Section 4.06.
F.   The Manager shall prepare and submit to Council and the Mayor the annual budget and capital programs for the coming year by the first meeting in June of each year.
G.   The Manager shall submit to Council and the Mayor and make available to the public written reports on a quarterly basis on the finances and administrative activities of the Village as well as at the end of each fiscal year.
H.   The Manager shall make such other reports as the Council may require concerning the operations of municipal departments, offices, boards, commissions, and agencies subject to the Manager's direction and supervision.
I.   The Manager shall serve as an ex-officio member of all boards and commissions which are authorized under this Charter or subsequently created by Council.
J.   The Manager shall submit a written report to Council and the Mayor on a quarterly basis as to the financial condition and future operating and capital needs of the Village. The Manager may make such recommendations to the Council concerning the affairs of the Village as the Manager deems desirable and shall make special reports as requested by Council.
K.   The Manager shall require reports and information of subordinate officers and employees of the Village in the orderly operation of the Village, or when required to do so by the Council or any board or commission of the Village.
L.   The Manager shall be the contracting officer of the Village and shall award and execute contracts and agreements on behalf of the Village in the manner and under the procedures required by Section 5.08 of this Charter. A bidding process shall be used for contracts and agreements exceeding a value to be determined by Ordinance of Council. Such Ordinance shall be reviewed by Council every two years. Failure to review the stated value by Council shall not invalidate an existing Ordinance.
   In lieu of public bidding, Council may by ordinance, provide for participation in joint purchasing programs operated by the State of Ohio or any department thereof. No purchase from such joint purchasing program in excess of the amount stated in the ordinance referred to in the preceding paragraph may be made unless an ordinance authorizing each such purchase shall be passed by Council.
M.   The Manager shall perform the duties and have the powers as conferred or required by this Charter, by any ordinance or resolution of the Council, or by the laws of the State of Ohio.
N.   In order to properly inform the Mayor, the Manager shall, when practical, meet with the Mayor not less frequently than once each week. The purpose of these meetings shall be to discuss activities, policies, schedules, public comments and/or other items relevant to Village operations.
O.   The Manager shall oversee operations and activities of all Village park facilities, meet regularly with members of the Recreation Board, and communicate routinely with park supervisory staff.
