452.13 SNOW EMERGENCIES.
   (a)   In the event that the Mercer County Sheriff declares a County-wide level one, level two or level three snow emergency for Mercer County, Ohio, no owner or operator of a motor vehicle shall park the same on any of the following streets within the Village:
      Main Street, from Fourth Street to Mill Street
      Second Street, from Walnut Street to Vine Street
      North Street, from Second Street to Mill Street
      Mill Street, from North Street to Main Street
      Market Street, from North Street to Walnut Street
      First Street, from North Street to Walnut Street
      Walnut Street, from Third Street to Market Street
from 11:00 p.m. until 6:00 a.m. A map setting forth said streets is attached to original Ordinance 1381, and made a part hereof.
   (b)   All vehicles parked prior to the Sheriff's declaration of a snow emergency shall be immediately removed by the owners or operators thereof. Any motor vehicle parked in violation of this section shall be removed upon the order of the Chief of Police of the Village, and the owner or operator thereof shall be subject to fines as hereinafter provided.
   (c)   It shall be the responsibility of the owners and operators of motor vehicles to ascertain whether or not weather conditions require the removal of their motor vehicles from the streets set forth herein. The Village shall make every effort to inform the public of the existence of weather conditions requiring removal of parked motor vehicles from the streets as set forth herein.
   (d)   This section shall be effective upon declaration of a level one, level two or level three snow emergency by the Mercer County Sheriff. In the event that such declaration is announced between the hours of 10:00 p.m. and 4:59 a.m., removal of all vehicles parked on the streets designated herein by the owners or operators shall be required within 60 minutes of said declaration. In the event that the snow emergency is declared between the hours of 5:00 a.m. and 9:59 p.m., removal of all vehicles parked on the streets designated herein by the owners or operators shall be required by 11:00 p.m. in order to facilitate snow removal. The Coldwater Chief of Police shall order the removal of all vehicles parked on the streets designated herein which have not been removed by the owners or operators thereof. Such vehicles shall be removed to a central location and records shall be kept by the Police Department of all vehicles removed.
   (e)   Whoever violates any of the provisions of this section shall be subject to a fine of not less than twenty-five dollars ($25.00) nor more than fifty dollars ($50.00) for each occurrence. When a motor vehicle is towed to a central location, the motor vehicle shall be recovered only upon the payment of towing and/or storage charges by the owner or operator thereof.
