249.09 SICK LEAVE.
   (a)   Each employee in the Municipal service shall be entitled, for each eighty hours of completed service, to sick leave of 4.6 hours with pay. Employees may use sick leave, upon approval of the Mayor or the Village Administrator, for absence due to illness, injury or exposure to a contagious disease which could be communicated to other employees. There shall be no limit to the number of days that can be accumulated. The previously accumulated sick leave of an employee who has been separated from the service of the Village may be placed to his or her credit upon his or her re-employment in the service of the Village. An employee who transfers from one department to another shall be credited with the unused balance of his or her accumulated sick leave. The Mayor or the Village Administrator may require an employee to furnish a satisfactory affidavit for his or her absence if such absence is three days or less. An employee who is absent on sick leave for more than three days shall furnish a certificate from a licensed physician as to the nature of his or her illness, or other acceptable reason for his or her absence. Sick leave will not be granted to an employee if he or she is sick or injured while on vacation. No sick leave will be granted to an employee after his or her retirement or termination of employment.
   (b)   Sick leave may be used for the illness or death of the spouse, children, step-children, father, mother, father-in-law, mother-in-law, son-in-law, daughter-in-law, brother or sister of the employee for a period not to exceed three days, and for the illness or death of the step-father, step-mother, grandparents, brother-in-law or sister-in-law of the employee for a period not to exceed one day. Sick leave for death in a family will not be granted if such death occurs while the employee is on vacation.
   (c)   Upon retirement, an employee shall be allowed full pay at his or her current rate of twenty-five percent of accumulated sick leave days. No employee shall be considered retired unless he or she has applied to the Public Employees Retirement System, or to the Police and Firemen's Disability and Pension Fund of the State, for retirement benefits and has been granted such benefits.
   (d)   No employee hired by the Village after January 1, 1981, shall be entitled to sick leave as accrued with any other employer.
   (e)   No employee shall receive holiday pay and sick leave pay for the same day. If an employee receives sick pay for the day immediately preceding or following a holiday, then he or she shall not receive holiday pay for that holiday.

   (f)   Any employee hired by the Village after January 1, 1996, who has accumulated unused sick leave with a previous employer, may be credited with all or a portion of said sick leave. The amount of sick leave credited shall be determined by a motion and affirmative vote of Council. The amount of unused sick leave accumulated by a previous employer shall be certified by the previous employer before any sick leave is credited.
