246.04 CONTRACTS FOR FIRE SERVICE.
   (a)   The Mayor and Clerk-Treasurer are hereby authorized to enter into contracts on behalf of the Village with such political subdivisions or fire companies owning motor-driven fire-fighting equipment, as they may deem proper, providing for the exchange of fire-fighting equipment and firemen in the event of an emergency. Such contracts shall define emergency as the existence of a fire so large that the township or municipality within whose limits such fire exists is unable to handle it. Such contracts shall not require either party thereto to leave its own territory unprotected or in jeopardy and shall provide that the party making such emergency run shall bear all expenses, loss or damage incurred thereby. Such contracts shall be for a period of three years. However, either party may terminate such contract upon thirty days notice in writing to the other party.
   (b)   In the event an emergency fire call is received from any municipality or department with which no such contract has been entered into, the Chief of the Fire Department or the Assistant Chief shall exercise his judgment and discretion as to whether such call shall be answered, and if so, what equipment and firemen shall be used in answering such call.
