1060.03 COMMERCIAL HAULERS; FRANCHISES AND SPECIAL PERMITS,
   (a)   No person except the holder of a franchise issued by Council, except as provided in subsection (c) hereof, shall commercially collect or transport garbage or other refuse in the Village. Such franchise shall be issued only after Council determines that the franchisee is capable of complying with the requirements of this chapter. A franchise shall be issued only to persons, firms or corporations equipped with sanitary, leakproof and easily cleanable vehicles. Leakage and spillage from vehicles transporting garbage and other refuse shall not be permitted.
   (b)   Such franchise shall be in the form of a contract executed on behalf of the Village by the Mayor and Clerk-Treasurer and approved by Council. It shall also be executed by the contractor. Only one contract shall be in force and effect at any time. The contract shall be for a term of five years and shall constitute an exclusive franchise between the Village and the contractor, except as provided in subsection (c) hereof.
   (c)   Major industries requiring special equipment for hauling and disposal of refuse may apply to Council for a special permit to be exempt from the exclusive features of the franchise. If such exemption is granted by Council, the holder of such special permit may contract with the franchisee or any other hauler for the collection and disposal of its refuse, but in no event shall such permit or contract extend beyond the expiration date of the Village franchise.
